Teaching Assistant Loses Religious Discrimination Case

A teaching assistant, Benedykt Dybowski, lost his legal case against a school that fired him for expressing his opposition to same-sex marriage and abortion. The employment tribunal ruled that the school acted appropriately to protect its reputation.


Dybowski worked at The Bishop of Llandaff Church In Wales High School, which dismissed him after he openly shared his views during a teacher training event and later repeated them in a meeting with the principal, Marc Belli. The school believed his beliefs did not align with its values and referred him to a regulator before terminating his employment in May 2023.


The tribunal agreed that the school had valid concerns about reputational risk, particularly as Dybowski was also an active campaigner on social media. The ruling noted that the principal reasonably concluded that Dybowski was unlikely to stop expressing his views within the school environment.


Following his dismissal, Dybowski set up an online fundraising page for legal costs and later appeared on GB News to discuss his case. After his TV appearance, the school began receiving hate mail from the public. In response, the school sent a letter to parents explaining that Dybowski was dismissed for using "highly charged language."


The tribunal rejected Dybowski’s claims of harassment, stating that his attempts to gain media attention contradicted his allegations.


Dybowski has announced he will appeal the decision and, if necessary, take his case to the UK Supreme Court and the European Court of Human Rights. Meanwhile, the school has welcomed the tribunal’s decision, reaffirming its commitment to diversity and inclusivity within its community.
